1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the Safety Anchor Alarm mobile application (“the App”) provided by Dijital Kafa Bilişim ve Danışmanlık A.Ş. (“Company,” “we,” “us,” or “our”), registered in İstanbul, Turkey.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Safety Anchor Alarm is a GPS-based anchor monitoring application for iOS devices. The App uses your device's GPS to monitor your boat's position relative to a set anchor point and alerts you if the distance exceeds a user-defined safe radius.

The App provides the following features:

GPS-based anchor position monitoring
Customizable safe radius alarm
Saved anchor points library
Anchoring calculators
Background monitoring with notifications
Lock screen widget for status monitoring

3. Important Safety Disclaimer

PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS IMPORTANT LIMITATIONS ON THE USE OF THE APP.

The App is intended as a supplementary aid only and should never be relied upon as your sole anchor monitoring method.
The App does not replace proper seamanship, anchor watches, or any other safety practices and equipment required by maritime regulations or good maritime practice.
GPS accuracy depends on environmental factors, satellite availability, device hardware, and signal conditions. GPS positions may be inaccurate by several meters or more.
The App relies on your device's battery, GPS hardware, and operating system. Device malfunctions, low battery, software updates, or iOS background activity management may interrupt monitoring without warning.
You are solely responsible for the safety of your vessel, crew, passengers, and property at all times. Always maintain proper anchor watches and follow safe anchoring practices regardless of whether you are using the App.
The App should not be used as a navigation aid or as a substitute for official nautical charts, navigation equipment, or maritime safety systems.

4. Eligibility

You must be at least 17 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

5. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a compatible iOS device that you own or control, for your personal, non-commercial use.

You may not:

Copy, modify, distribute, sell, or lease any part of the App
Reverse engineer, decompile, or disassemble the App
Remove, alter, or obscure any proprietary notices in the App
Use the App for any unlawful purpose or in violation of any applicable laws or regulations
Use the App in any manner that could damage, disable, overburden, or impair the App

6. Intellectual Property

The App, including its design, features, content, code, and all related intellectual property, is owned by Dijital Kafa Bilişim ve Danışmanlık A.Ş. and is protected by copyright, trademark, and other intellectual property laws.

The Safety Anchor Alarm name and logo are trademarks of Dijital Kafa Bilişim ve Danışmanlık A.Ş. You may not use these trademarks without our prior written consent.

7. User Responsibilities

By using the App, you agree to:

Use the App in compliance with all applicable maritime laws, regulations, and safety standards
Maintain adequate anchor watches and safety precautions regardless of App usage
Ensure your device is adequately charged and GPS is functioning properly before relying on the App
Keep the App updated to the latest version for optimal performance and reliability
Not rely solely on the App for vessel safety in any circumstances

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIJITAL KAFA BİLİŞİM VE DANIŞMANLIK A.Ş., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses
Any damage to your vessel, property, or person arising from or related to your use of or inability to use the App
Any failure of the App to provide timely or accurate alerts, including but not limited to failures caused by GPS inaccuracy, device malfunction, battery depletion, software errors, or operating system behavior
Any loss or damage resulting from anchor dragging, vessel grounding, collision, or any other maritime incident regardless of whether the App was in use at the time

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Indemnification

You agree to indemnify, defend, and hold harmless Dijital Kafa Bilişim ve Danışmanlık A.Ş. and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or your violation of these Terms.

10. Apple App Store Terms

The following terms apply to the extent that the App is accessed through or downloaded from the Apple App Store:

These Terms are between you and Dijital Kafa Bilişim ve Danışmanlık A.Ş. only, and not with Apple Inc. (“Apple”).
Apple has no obligation to provide any maintenance or support services with respect to the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated as a “terrorist supporting” country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

You may terminate these Terms at any time by deleting the App from your device. All provisions of these Terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of İstanbul, Turkey.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dijital Kafa Bilişim ve Danışmanlık A.Ş. regarding the App and supersede all prior agreements.
